TENANT
The following is a guide as to the process and cost involved renting a property:
HOLDING DEPOSIT
Upon acceptance of an offer for an application to rent a property Hampton-Heath will require an equivalent to 1 week’s rent as a holding deposit as payment to reserve a property. Any offer accepted by the landlord is subject to satisfactory references, right to rent checks and contract. *The Preliminary Deposit does not constitute the granting of a contract or tenancy.
Please note the following:
- The holding deposit must be returned to the tenant: either in payment back to the tenant, or being put towards the first rental payment, or the security deposit. (We will only be able to hold the holding deposit for 15 days unless another ‘deadline’ date is agree in writing. Therefore, it’s imperative to process matters swiftly in order for your application to be accepted.
The holding deposit can be forfeited for the following reasons:
- The tenant withdraws
- The tenant doesn’t take all reasonable steps to enter the tenancy
- The tenant fails a right to rent check
- The tenant provides misleading or fraudulent information which materially affects their suitability to rent the property.
CONFIRMATION OF ACCEPTANCE AND REFERENCING
Following payment of the holding deposit amount you will be sent an electronic application to rentwhich will confirm the terms of the acceptance of your offer.
Referencing will be carried out by a third-party company; we will provide you with the necessary online application forms to complete. Once the referencing process is complete, the referencing company will provide us with the final reports which in turn are issued to the landlord for their approval and then only will the tenancy agreement be drafted.
IDENTIFICATION
Proof of photographic Identification and (residence/permit visa if applicable) during the referencing process for right to rent checks i.e. copy of passport along with proof of address dated within the last 3 months.
STATEMENT OF ACCOUNT
Before the tenancy starts (payable to Hampton-Heath ‘the Agent’)
•As well as paying the rent, tenants may also be required to make the following permitted payments.
•Holding Deposit: 1 week’s rent (a holding deposit is a payment made by the tenant to reserve a property.
•Tenancy Deposit: 5-week weeks’ rent where the annual rent is less than £50,000; or six weeks’ rent where the annual rent is £50,000 or more The 1 weeks holding fee will be put towards the first rental payment, or the security deposit.
TENANCY AGREEMENT & PAYMENT OF INITIAL MONIES:
Upon reviewing and then signing the electronic tenancy agreement, you must pay the balance of first period’s rent and security deposit minus the preliminary holding deposit. Balance monies due should be paid by bank transfer and received in cleared funds. It’s advised that the tenancy agreement should be signed within 72 hours of receipt to ensure all reasonable steps are being taken to enter the tenancy.
Hampton-Heath and the landlord are unable to grant possession of any property until the conditions above have been met. Our client the landlord will only sign the tenancy agreement once Hampton-Heath confirm this has been done. We strongly recommend you seek legal advice before the signing of the tenancy agreement.
TENANCY START DATE & CHECK IN:
The Landlord or the landlords independently appointed inventory clerk will meet you at the property on the moving date, at an agreed time to conduct the check in appointment. This will include meter readings, going through the inventory compiled and handing over of keys.
PERMITTED PAYMENTS DURING THE TENANCY:
(a) Late Rent Fees
- Payment of interest for the late payment of rent at a rate of 3% plus the Bank of England’s base interest rate (For Example, 3% plus the base rate of interest for each day that the payment has been outstanding after 14 days)
(b) Lost Keys
- Payment for the reasonably incurred costs for the loss of keys/security devices. Tenants will be charged for losing their keys (or other security device if your property is high-tech). (For Example, a charge of £5 to replace a lost key if a receipt can be produced for £5 for getting a new key cut. Evidence of the cost will be provided.
(c) Changes to Tenancy
- Payment of up to £50.00 if you want to change the tenancy agreement (For Example, adding a new tenant to the tenancy or allowing a pet)
PERMITTED AND IF APPLICABLE PAYMENTS DURING THE TENANCY (PAYABLE TO THE PROVIDER)
- Utilities – gas, electricity, water
- Communications – telephone and broadband
- Installation of cable/satellite
- Subscription to cable/satellite supplier
- Television licence
- Council Tax
OTHER PERMITTED PAYMENTS:
- Any other permitted payments, not included above, under the Tenant Fees Act 2019 including contractual damages.
